Welcome to Torque Optics. These Terms govern your use of torqueoptics.com and any purchase you make from us. By using the site or placing an order, you agree to these Terms.
Who we are
This site is operated by Torque Brands LLC, doing business as Torque Optics, referred to in these Terms as "Torque Optics," "we," "us," or "our." Torque Optics is powered by Shopify, which enables us to provide our Services to you.

Eligibility
You must be at least 18 years old and able to enter a binding contract to purchase from us. By using the site, you represent that you are at least the age of majority in your state or province of residence, and that you consent to any minor dependents using the Services on devices you own or manage.

These Terms include and incorporate our Privacy Policy, Shipping Policy, Return and Refund Policy, One-Year Limited Warranty, Kickstarter Backer Addendum, and any product-specific terms shown at checkout or on a product page.
If there is a conflict between these Terms and a specific promotion's terms, the promotion terms govern for that promotion.
Some post-purchase services, including returns, exchanges, warranty claims, package claims, or order support, may be handled through a third-party platform. Use of that platform does not change Torque Optics' return, refund, shipping, or warranty eligibility rules unless specifically stated at checkout or in writing by us.
Our products
We try to describe products accurately. Colors, finishes, and specs may vary slightly from images, which are for illustration, due to differences in devices and screen settings. Specifications can change as we improve the product.
We do not warrant that the appearance or quality of any product will exactly match how it's depicted in our store. All product descriptions are subject to change at any time without notice, and we reserve the right to discontinue any product or limit quantities available to any person, region, or jurisdiction.
Product safety
Torque Optics sunglasses are designed for general outdoor eyewear use.
Unless a specific product page says otherwise, they are not safety glasses, impact-rated protective eyewear, welding shields, or medical devices, and should not be relied on for those purposes.
For any activity requiring rated eye protection, including industrial work, shooting sports, motorsports, welding, or lab work, please use eyewear certified for that use.
Orders and pricing
All orders are offers to buy. Your order is not accepted until we confirm acceptance, and we must receive and process your payment first. We may accept, decline, or cancel any order at our discretion, including for pricing errors, suspected fraud, payment risk, address verification issues, or stock issues. Please review your order carefully before submitting — we may be unable to accommodate cancellation requests once an order is accepted.
Prices are in USD and may change without notice. Taxes, shipping, and any optional post-purchase services are added at checkout where applicable.
You represent that your purchases are for your own personal or household use and not for commercial resale or export.
Occasionally the site may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, or availability. We reserve the right to correct these, and to change, update, or cancel an order affected by inaccurate information, even after you've submitted it.
Payment
You authorize us to charge your payment method for the full order total, including taxes, shipping, and any optional services selected at checkout. You represent that your payment information is accurate and that you're authorized to use the payment method provided. If payment fails or is declined, the order is void.
Fraud and order review
We reserve the right to cancel, hold, or refuse any order flagged for suspected fraud, payment risk, or address verification issues. We'll reach out if we need more information from you.
SMS messaging
By providing your mobile number and opting in, you agree to receive recurring automated marketing and transactional text messages from Torque Optics at that number, including messages sent using an automatic telephone dialing system. Consent is not a condition of any purchase.
Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. After you text STOP, we'll send one confirmation message and then stop sending, though you may continue to receive messages from any other Torque Optics program you separately joined.
Message delivery is not guaranteed in all areas or on all devices, and carriers are not liable for delayed or undelivered messages. Your submission of a mobile number is also governed by our Privacy Policy.
Intellectual property
All content on the site, including logos, text, images, video, product designs, graphics, and other materials, belongs to Torque Optics or our licensors, and is protected by U.S. and foreign intellectual property laws.
You may not copy, redistribute, modify, create derivative works from, or use our content commercially without written permission. Shopify's name, logo, and trademarks belong to Shopify, not to us, and nothing here grants you rights to them.
Optional tools and third-party apps
The Services may include tools or features provided by third parties that we don't control or monitor. We provide access to these "as is," without any warranty, and we're not responsible for your use of them. Any use of third-party tools is at your own risk, and you should review that provider's own terms before relying on them.
Third-party links
The site may contain links to third-party websites. We don't examine or vouch for the content, accuracy, or practices of any third-party site, and we're not liable for any harm connected to your use of one. If you leave our site to visit a linked page, you do so at your own risk.
User conduct
Do not use the site to break the law, harass others, interfere with how the site runs, or attempt to access systems or data without authorization.
Do not use bots, scrapers, crawlers, or other automated tools to access the site, collect data, or place orders without our written permission. Do not upload malicious code, attempt to bypass our security measures, impersonate another person, or use the site to send spam or unsolicited advertising.
We reserve the right to suspend, disable, or terminate access to the Services at any time, without notice, if we determine these Terms have been violated.
AI agents
If you use, enable, or deploy an AI agent (software that takes autonomous or semi-autonomous action on your behalf) to access or interact with our Services, that agent must clearly identify itself as an agent in its requests, must not attempt to mimic human behavior or bypass bot-detection measures such as CAPTCHAs, and must respond truthfully if asked whether it is a human or automated system. We may limit or block agent access to the Services at our discretion, including by technical measures.
User-generated content
If you submit a product review, comment, photo, video, testimonial, or other content to the site or to us, you grant Torque Optics a non-exclusive, royalty-free, worldwide license to use, display, reproduce, edit, and share that content in connection with our business, including on the site, in marketing, in advertising, in emails, and on social media, with attribution where practical.
You confirm that:
- The content is your own original work, or you have permission to share it.
- The content does not violate anyone's rights.
- The content does not contain unlawful, harmful, misleading, or confidential material.
- We may edit it for length, clarity, formatting, cropping, or appropriateness, or decline to publish it.
We will not use customer-submitted photos, videos, reviews, testimonials, voice recordings, names, likenesses, or other user-generated content to train generative AI systems, create synthetic voice or image replicas, generate AI avatars, or build models that replicate a customer's voice, face, likeness, or identity.
We may use ordinary software tools to format, resize, caption, crop, moderate, organize, or publish user-generated content, but not to create AI-generated replicas of a customer's voice, face, likeness, identity, or creative work.
We do not pre-screen all user content and are not responsible for opinions or claims made by reviewers.
Feedback
If you send us ideas, suggestions, or feedback about our business, products, or site that are separate from a public review or UGC submission above, you grant us a royalty-free, worldwide license to use that feedback for any business purpose, without any obligation to compensate you or keep it confidential. Please don't submit feedback that infringes someone else's rights or that you don't have permission to share.
Our relationship with Shopify
Torque Optics is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Torque Optics. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Torque Optics, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Torque Optics.
Because our Services are hosted by Shopify, Shopify also collects and processes personal information about your access to and use of the Services in order to provide and improve them. See our Privacy Policy for more on how we and Shopify use your information.
Disclaimers
The site and products are provided "as is," except for our written One-Year Limited Warranty.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES AND CONDITIONS, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY PROVIDED IN OUR WRITTEN WARRANTY. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. Some jurisdictions do not allow these limitations, so they may not apply to you.
Limitation of liability
To the maximum extent permitted by law, the total liability of Torque Optics, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors — or those of Shopify and its affiliates — for any claim related to a product, order, service, or the site is limited to the amount you paid for the product giving rise to the claim.
We are not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits or lost data, even if advised of the possibility of such damages.
Indemnification
You agree to indemnify and hold harmless Torque Optics, Shopify, and our respective affiliates, officers, directors, employees, agents, and service providers against claims, damages, and reasonable attorneys' fees arising from your misuse of the site or products, your violation of these Terms, or your violation of another person's rights.
Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, including carrier delays, customs holdups, weather, natural disasters, labor disruptions, supplier issues, pandemic-related disruptions, government actions, or other events we cannot reasonably prevent.
Termination
We may suspend or terminate your access to the Services at any time, without notice, at our discretion. You'll remain responsible for any amounts due as of the date of termination. Sections that by their nature should survive termination — including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, and Governing Law — will continue to apply.
Severability
If any part of these Terms is found unenforceable, the rest stays in effect.
Waiver; entire agreement
Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with the policies they incorporate, are the entire agreement between you and us regarding the Services, and supersede any prior agreements or communications on the same subject.
Assignment
You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may transfer or assign these Terms, in whole or in part, at any time without notice to you.
Governing law and venue
These Terms are governed by the laws of the State of Oregon, without regard to conflict of laws principles.
Any dispute arising from these Terms or your purchase will be brought in the state or federal courts located in Washington County, Oregon, and you consent to that venue.
Headings
Headings in these Terms are for convenience only and don't affect their interpretation.
Changes
We may update these Terms from time to time. The current version always lives at this URL. Continued use of the site after changes means you accept the updated Terms.
