Privacy policy

If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.
We collect what we need to ship your sunglasses, support your order, process returns and warranty claims, and run the business. We do not sell your personal information for money, and you can ask us to delete it.
What we collect
We may collect the following categories of information:
Identifiers and contact information: name, shipping address, billing address, email address, and phone number.
Commercial information: order history, products viewed, items purchased, return history, warranty claim history, and customer service history.
Payment information: processed by our payment providers, such as Stripe, Shop Pay, PayPal, or similar providers. We do not store full card numbers.
Internet and device activity: IP address, browser, device type, pages viewed, referral source, and similar information collected through cookies, pixels, server-side tracking, and analytics tools.
Approximate geolocation: general location inferred from IP address, not precise GPS location.
Communications: emails, support messages, return requests, warranty claims, photos or videos submitted for product issues, and SMS conversations if you opt in.
User-generated content: reviews, comments, testimonials, photos, videos, names, likenesses, or other content you choose to submit to us or post through site features.
How we use it
We use personal information to:
- Fulfill orders.
- Process payments.
- Ship products.
- Provide customer support.
- Process returns, exchanges, warranty claims, and package claims.
- Prevent fraud and payment abuse.
- Send order updates and transactional messages.
- Send marketing messages with your consent.
- Display customer-submitted reviews, photos, videos, testimonials, or other content when you choose to submit it, but not for AI training, synthetic likeness creation, or machine learning model development.
- Improve the site, products, advertising, and customer experience.
- Meet legal, tax, warranty, and recordkeeping obligations.
Legal bases for processing (EU, EEA, and UK)
If you are located in the European Union, the European Economic Area, or the United Kingdom, we process your personal information under the following legal bases:
Performance of a contract (Art. 6(1)(b) GDPR): to accept and fulfill your order, process payment, ship your products, provide customer support, and handle returns, exchanges, and warranty claims.
Consent (Art. 6(1)(a) GDPR): to send marketing email and SMS, and to set non-essential cookies and similar tracking technologies. You may withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal.
Legitimate interests (Art. 6(1)(f) GDPR): to prevent fraud and payment abuse, secure our site, understand how our products and marketing perform, and improve our products and customer experience. We balance these interests against your rights and freedoms.
Legal obligation (Art. 6(1)(c) GDPR): to meet tax, accounting, consumer protection, product safety, and recordkeeping requirements.
We do not use your personal information for automated decision-making or profiling that produces legal effects or similarly significant effects for you.
Who we share it with
We share information with service providers that help us operate the business, including:
- Payment processors.
- Shipping carriers.
- Return, exchange, warranty, package protection, and post-purchase support platforms, including Redo.
- Email and SMS platforms.
- Customer support tools.
- Analytics providers.
- Advertising platforms.
- Fraud prevention tools.
- Professional advisors when needed.
We may also share information if required by law, subpoena, legal process, or to protect our rights, customers, business, or property.
If our business is acquired, merged, reorganized, or sold, customer information may be transferred as part of that transaction.
Server-side tracking and conversion data
In addition to browser-based cookies and pixels, we use a server-side data platform to send order and event information directly from our systems to our analytics and advertising partners, including Meta, Google, and our email and SMS platform.
This means certain information, including hashed identifiers such as your email address or phone number, order value, and the products you viewed or purchased, may be transmitted from our servers rather than from your browser. We use this to measure advertising performance, attribute orders accurately, and reduce duplicate or missing data.
Server-side tracking may continue to send information even when browser-level tracking is blocked. You can opt out of this activity by emailing optout@torqueoptics.com, using the Your Privacy Choices link in our footer, or enabling the Global Privacy Control signal in your browser. Our relationship with Shopify
Our site is hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve those Services for us. Information you submit to the site will be transmitted to and shared with Shopify, and may be shared with third parties located in countries other than where you reside, in order to provide and improve the Services for you.
To help protect, grow, and improve our business, we may use certain Shopify features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information for those purposes, including for responding to your requests to exercise your rights over that use. To learn more about how Shopify uses your personal information and any rights you may have, you can visit the Shopify Consumer Privacy Policy. Depending on where you live, you may also be able to exercise certain rights through the Shopify Privacy Portal.
AI and user-generated content
We do not use customer-submitted photos, videos, reviews, testimonials, voice recordings, names, likenesses, or other user-generated content to train generative AI systems, create synthetic voice or image replicas, generate AI avatars, or build models that replicate a customer's voice, face, likeness, or identity.
We may use ordinary software tools to format, resize, caption, crop, moderate, organize, or publish user-generated content, but not to create AI-generated replicas of a customer's voice, face, likeness, identity, or creative work.
Sale, share, and targeted advertising
We do not sell your personal information for money.
We do use analytics and advertising tools, such as Google Analytics, Meta Pixel, server-side conversion tracking, and similar platforms, that may collect or receive information from our site to help us measure performance and show relevant ads.
Depending on where you live, this activity may be considered "sharing," "targeted advertising," or a "sale" under your state's privacy law, even though no money changes hands. As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined under applicable law) the personal information of individuals under 16 years of age.

If you visit our website with the Global Privacy Control (GPC) opt-out preference signal enabled, we will treat this as a request to opt out for the device and browser you used to visit the site, where required by law. Notice of financial incentive
From time to time we offer a discount, promotional code, or similar benefit when you sign up for our email or SMS marketing with your email address or mobile phone number. Because these offers are tied to the collection of your personal information, they may be considered a financial incentive under California law.
What we collect: your email address, your mobile phone number, or both, depending on how you sign up.
Material terms: the specific offer, its value, and any conditions or expiration are shown at the point of signup and in the offer itself. Offers vary, may be limited to first-time customers or eligible orders, and may be changed or discontinued at any time.
How to opt in: enter your email address or phone number in our signup form and confirm your consent to receive marketing messages.
How to withdraw: you can withdraw at any time by unsubscribing from any marketing email, replying STOP to any marketing text, or emailing optout@torqueoptics.com. Withdrawing does not cancel an offer you have already used.
Value of your information: we estimate the value of the personal information collected through this program to be approximately equal to the value of the offer extended. We calculate this using the expense of the incentive itself, since we do not sell this information for money and we cannot reasonably assign it a greater value.
Participation is entirely voluntary, and you can purchase from us without signing up.
Sensitive personal information
We do not intentionally collect sensitive personal information such as government ID numbers, precise geolocation, health information, biometric data, racial or ethnic origin, or financial account credentials beyond what is needed to process your payment.
Please do not send us sensitive personal information unless we specifically ask for it.
Your rights
Depending on where you live, you may have the right to access, correct, delete, or port your data, and to opt out of certain processing or targeted advertising.
These rights may apply, among others, to residents of Oregon under the Oregon Consumer Privacy Act, California under the CCPA/CPRA, Colorado, Connecticut, Virginia, and other states with comparable privacy laws.
If you are located in the EU, EEA, or UK, you also have the right to access your personal information, correct it, request its erasure, restrict or object to how we process it, receive it in a portable format, and withdraw consent at any time. You have the right to lodge a complaint with your local supervisory authority or data protection authority.

We may need to verify your identity before completing a privacy request, usually by checking your request against your order history or account information.
You may also designate an authorized agent to act on your behalf where the law allows.
If we deny a request, you may appeal by replying to our response and asking us to review it again.
Cookies and tracking
We use cookies and similar technologies for cart functionality, analytics, advertising, and site performance.
You can:
- Disable or limit cookies in your browser settings, though parts of the site may not work properly.
- Use platform-level opt-outs from the Network Advertising Initiative or Digital Advertising Alliance.
- Use the Your Privacy Choices link in our footer.

Note that disabling browser cookies does not by itself stop server-side conversion tracking. See "Server-side tracking and conversion data" above.
Marketing
You can unsubscribe from marketing email any time using the link in any marketing message, or by replying and asking us to remove you.
For SMS, reply STOP to unsubscribe.
Transactional messages, including order confirmations, shipping updates, return updates, warranty updates, and other order-related communications, may still be sent because they are part of fulfilling or supporting your order.
Data retention
We keep order records as long as we need them for tax, legal, warranty, fraud prevention, and business purposes, typically 7 years.
We may keep certain return, warranty, and customer support records for as long as reasonably necessary to support our products, resolve disputes, and comply with legal obligations.
Marketing contact information is retained until you unsubscribe or ask us to remove you.
Security
We use reasonable technical and organizational safeguards to protect your information.
No system is perfectly secure, and we will not pretend otherwise.
International users
If you access our site or place an order from outside the United States, your information will be processed and stored in the United States, where privacy laws may differ from those in your country. By using the site, you consent to that transfer.
If we transfer personal information out of the European Economic Area or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses, or equivalent contracts issued by the relevant UK authority, unless the transfer is to a country already determined to provide an adequate level of protection.
Children
Our site is not directed to children under 16, and we do not knowingly collect personal information from anyone under 16.
If you believe a child has provided us information, email us and we will delete it.
Changes
We may update this policy from time to time. The current version always lives at this URL.
